The present provisions establish the general terms and conditions of sale and use proposed by BALTHAZAR BEL HASARD on its website balthazarbelhasard.com and aim to define the terms of sale of interior decoration and fashion items between BALTHAZAR BEL HASARD and the Customer when placing an order, from payment to delivery.

BALTHAZAR BEL HASARD is a company registered under SIRET number 91306163600019, with its headquarters located at 277 avenue d'Argenteuil, Bois-Colombes, and can be reached by email at: contact@balthazarbelhasard.com.

Purchasing an item through the website balthazarbelhasard.com implies unreserved acceptance by the buyer of these terms and conditions of sale and use.

These terms and conditions shall prevail over any other general or special conditions not expressly agreed upon by the seller.

BALTHAZAR BEL HASARD reserves the right to modify its terms and conditions at any time. In this case, the applicable conditions will be those in effect on the date the buyer places the order.

This website and all associated rights are the property of BALTHAZAR BEL HASARD.

Any reproduction, in whole or in part, including the BALTHAZAR BEL HASARD trademark, is subject to prior authorization by the owner.

ARTICLE 1 – PRODUCTS

The products offered by BALTHAZAR BEL HASARD are interior decoration and fashion items.

Products are offered while stocks last. Only items listed in the store on the day of the buyer's visit are available for sale.

They are accompanied by a description as detailed as possible but not exhaustive, and by non-contractual photos. Product photos are as accurate as possible but cannot guarantee a perfect match with the offered product, particularly regarding color, which may vary between different computers.

In case of unavailability after the order has been placed, the buyer will be informed by email and invited to modify their order or cancel it, without any claim for damages against BALTHAZAR BEL HASARD. BALTHAZAR BEL HASARD will refund any potential payments for the canceled order to the buyer.

ARTICLE 2 – CERTIFICATE OF AUTHENTICITY

Each piece is unique. Each piece is designed, handcrafted, and/or hand-retouched.

All our wall art and porcelain collection pieces are accompanied by a certificate of authenticity and are signed by the author.

ARTICLE 3 – ORDER

Buyers wishing to purchase a product on the BALTHAZAR BEL HASARD website must have the legal capacity or parental authorization to place an order.

The sale will only be finalized after a confirmation email is sent by BALTHAZAR BEL HASARD, indicating the order number, provided that the email address provided by the buyer does not contain errors. The buyer must verify the accuracy of the information provided to BALTHAZAR BEL HASARD. The company cannot be held responsible for any input errors and their consequences in terms of delays or delivery errors. All costs incurred for re-shipping will be the responsibility of the buyer.

In order to validate any order, the buyer must accept the general terms and conditions of sale and use. In the event of an error in the recipient’s details after placing the order, please contact us via email at contact@balthazarbelhasard.com.

ARTICLE 4 – PRICING AND SECURE PAYMENT

*PRICING

The prices listed on the website balthazarbelhasard.com are in euros, including all taxes (TTC). They do not include shipping costs, which are charged in addition to the price of the purchased items. Shipping fees will be indicated before the buyer registers their order.

BALTHAZAR BEL HASARD reserves the right to change its prices at any time. However, it commits to invoicing the goods ordered at the price indicated at the time of the order’s registration.

*SECURE PAYMENT

BALTHAZAR BEL HASARD uses all necessary means to ensure the security and confidentiality of data transmitted online.

All information is encrypted via SSL (Secure Sockets Layer) protocol. This data cannot be detected, intercepted, or used by third parties. It is also not stored on our systems. When you are asked to enter your credit card number, you can verify that you are in a secure zone by checking your browser.

You have several payment methods available for your purchases on the balthazarbelhasard.com website:

  • By bank card: Payments are made via the STRIPE secure payment platform. This implies that no banking information about you transits through our website. Your order will be recorded and validated once your bank accepts the payment.

  • By PayPal: With PayPal, your financial information is never communicated to our website. PayPal encrypts and secures your card number. Pay online simply by entering your email address and password.

The order validated by the buyer will only be considered effective, and the goods will be shipped, once the respective banking centers have approved the payment. In case of refusal by these centers, the order will be automatically canceled, and the customer will be notified by email. A detailed invoice will be available on the website under the "My Account" section.

ARTICLE 5 – ARCHIVING

BALTHAZAR BEL HASARD archives order records on a reliable and durable medium, constituting a faithful copy in accordance with the provisions of Article 1348 of the French Civil Code. The computerized records of BALTHAZAR BEL HASARD will be considered by the parties as proof of communications, orders, payments, and transactions made between BALTHAZAR BEL HASARD and the buyer.

ARTICLE 6 – DELIVERY, TIMEFRAMES, AND RATES

*DELIVERY

Deliveries are handled by independent service providers. All parcels are traceable with a tracking number and can optionally be delivered by hand with a signature.

In metropolitan France, deliveries are handled by La Poste – Colissimo.

In EU countries, deliveries are made via La Poste – Colissimo suivi Europe.

Deliveries outside the EU are handled by international postal services.

For deliveries outside metropolitan France, the buyer agrees to pay all taxes due on product importation, including customs duties, VAT, and any other taxes imposed by the receiving country.

Shipping risks are borne by the buyer. BALTHAZAR BEL HASARD cannot be held responsible for delivery delays, losses, damages, or other issues during delivery. Once the parcel is handed over and recorded at the post office, BALTHAZAR BEL HASARD has no further liability. For this reason, we recommend opting for delivery insurance. Upon receipt of the package, the buyer must check the condition of the products before accepting delivery. In case of damage during delivery, the buyer must note their reservations on the delivery slip and confirm them to the carrier by registered letter with acknowledgment of receipt within three (3) days of delivery, in accordance with Article L.133-3 of the French Commercial Code. The buyer must also send a registered letter with acknowledgment of receipt to BALTHAZAR BEL HASARD within eight (8) days of receiving the package, reporting any transportation-related damages. Claims will not be accepted if these formalities are not followed.

If you have not received your Colissimo parcel after 5 days and no delivery notice has been left, please check your parcel’s status on the La Poste website.

Products are delivered with the corresponding invoice to the address indicated by the buyer on the order form. In case of delivery errors due to an incorrect delivery address provided by the buyer, return and/or reshipping costs will be borne by the buyer. In the absence of a recipient, a delivery notice will be left, allowing the buyer to collect the parcel from their local post office with a valid ID.

BALTHAZAR BEL HASARD will be released from its obligation to deliver in the following circumstances:

  • Non-compliance by the buyer with any of their obligations (payment of the price, accuracy of personal information).
  • Occurrence of a force majeure event such as war, riot, fire, strikes, accidents, or the inability to procure supplies.

*TIMEFRAMES

Delivery times are indicative only. They represent the means of processing, preparing, and shipping the order. While every effort is made to ensure these times are met, no guarantees are given. Delivery times for international shipments may vary by several days. The delivery period begins only after the order has been fully paid.

Parcels are prepared on demand from Monday to Friday in the Paris region. Some products are made exclusively for the buyer upon order. The estimated shipping time is 5 to 10 working days after payment. Working days do not include weekends or public holidays.

For made-to-order products, any reasonable delivery delay will not entitle the buyer to claim damages or cancel the order.

In any event, the buyer can track the delivery status of their parcel on the La Poste website.

In the case of delivery delays, the buyer should notify us by email at contact@balthazarbelhasard.com. BALTHAZAR BEL HASARD will contact La Poste to open an inquiry (maximum delay of 21 days). If the product is found within this period, it will be shipped to the buyer’s address. If not found after 21 days, La Poste considers the parcel lost.

The absence of a dispute by the buyer within 30 days of placing the order will serve as confirmation, and the product will be deemed delivered and accepted. It is the buyer’s responsibility to raise any issues before this period to allow for appropriate verifications. No claims will be accepted after this confirmation or time limit.

*RATES

Shipping fees are the responsibility of the buyer.

They include packaging, handling, and postal charges.

Shipping costs are calculated on a flat-rate basis, depending on the destination country and the weight of the package.

If the buyer wishes to insure their package against loss or theft, they may choose the Colissimo option with insurance at the time of delivery selection. In this case, a Colissimo with signature will be sent.

ARTICLE 7 – WITHDRAWAL AND REFUND

*WITHDRAWAL

In accordance with Article L121-20 of the French Consumer Code, when a product has been purchased by a consumer from a professional seller, the buyer has a period of 14 working days from the date of receipt of the products to exercise their right of withdrawal without having to justify reasons or pay penalties, except for return shipping costs.

All returns must be pre-approved by BALTHAZAR BEL HASARD and assigned a return number.

To facilitate the processing of the request, BALTHAZAR BEL HASARD asks the buyer to send an email to the following address: contact@balthazarbelhasard.com, indicating the order number. The buyer must then return the item along with the invoice to the following address:
BALTHAZAR BEL HASARD – 277, avenue d’Argenteuil 92270 Bois-Colombes.

*REFUND

Products must be returned in their original packaging, with all accompanying items (certificate of authenticity, map, etc.), and must not have sustained any minor damage. Damaged or incomplete products will not be accepted.

Important: Products in the Wall Art category must be returned without any creases and in their original sealed plastic packaging with the provided stickers intact. The transparent plastic packaging allows the buyer to fully appreciate the size, aesthetic, and fit of the product. Since direct handling can damage these items, any product with opened packaging will be refused during the return examination.

Return shipping costs and the associated transport risks are the responsibility of the buyer. Therefore, the buyer must retain proof of the return.

Once your return is received and inspected, we will send you an email confirming receipt of the returned item. We will also notify you of the approval or rejection of your refund.

If your return is approved, your refund will be processed, and a credit will be automatically applied to your credit card or original method of payment within a few days.

ARTICLE 8 – DATA PROTECTION

The personal information requested by BALTHAZAR BEL HASARD is essential for managing the buyer's order. The personal data recorded on this site will be stored and used in accordance with the law of January 6, 1978, relating to data protection and privacy. The buyer has the right to access, modify, rectify, and delete their personal data at any time with BALTHAZAR BEL HASARD. They can exercise this right by sending a request via email to BALTHAZAR BEL HASARD: contact@balthazarbelhasard.com.

ARTICLE 9 – INTELLECTUAL PROPERTY

All elements of the balthazarbelhasard.com website are and remain the intellectual and exclusive property of BALTHAZAR BEL HASARD. No one is authorized to reproduce, exploit, redistribute, or use any part of the website’s content, even partially.

ARTICLE 10 – APPLICABLE LAW AND JURISDICTION

These terms are subject to French law.
In the event of a dispute, only French courts will have jurisdiction.
